📜 Terms of Service – The Branch (Pty) Ltd

These Terms of Service (“Terms”) govern your access to and use of the website, products, services, and premises operated by The Branch (Pty) Ltd (“The Branch”, “we”, “us”, or “our”).

By accessing our website, placing an order, visiting our premises, or using any of our services, you agree to be bound by these Terms, together with our Privacy Policy and Return & Refund Policy, which are incorporated by reference.
If you do not agree to these Terms, you may not use our Services.

1. Legal Capacity & Age Restrictions

1.1 General Age Requirement

You must be 18 years or older (or the age of legal majority in your jurisdiction) to access our website and purchase products.

1.2 Regulated & THC Products

Access to, and purchase of, any THC or otherwise regulated products, as well as access to our 420-Friendly Bar & Lounge, is strictly limited to customers who:

  • Meet the applicable legal age requirements; and

  • Successfully complete The Branch’s internal membership, age, and identity verification procedures, as required under South African law.

You warrant that all information you provide for verification or membership purposes is true, accurate, and complete.

1.3 Lawful Use

By purchasing regulated products, you confirm that:

  • The purchase is for private, personal use only; and

  • You will comply with all applicable laws relating to possession, transport, storage, and use of such products.

2. Products & Services

2.1 Product Information

We take reasonable care to ensure that product descriptions, pricing, and images are accurate. However, we do not warrant that all descriptions, colours, or content are entirely error-free, and minor variations may occur.

2.2 Grow Shop Supplies

Grow supplies and related equipment are sold strictly for lawful, private-use cultivation. The Branch accepts no responsibility or liability for the misuse of these products in contravention of South African law.

2.3 Pricing

All prices are quoted in South African Rand (ZAR) and include VAT where applicable. Delivery fees are calculated separately at checkout.
We reserve the right to amend prices, product availability, or promotions at any time without prior notice.

3. Orders & Payment

3.1 Order Acceptance

An order confirmation email does not constitute acceptance of your order. We reserve the right to accept, decline, or cancel any order after receipt for reasons including (but not limited to):

  • Product availability

  • Verification failure

  • Pricing or listing errors

  • Suspected misuse or non-compliance with law

If an order is cancelled after payment, a refund will be processed in accordance with our Return & Refund Policy.

3.2 Payment

All orders and services must be paid in full before dispatch or delivery.
Payments are processed via secure third-party payment gateways. We do not store your card or payment details.

4. Delivery, Collection & Risk

4.1 Local Delivery

Local delivery is limited to the areas, distances, and fees outlined in our Delivery Information Policy. Orders outside these limits may be cancelled or offered alternative courier options.

4.2 Verification on Delivery

For regulated or THC products:

  • Age and identity verification is mandatory at delivery

  • Failure to provide valid verification will result in the order being returned

  • A cancellation or delivery fee may be charged where delivery was attempted

4.3 Risk & Ownership

Risk of loss and ownership of goods passes to you:

  • Upon handover to a third-party courier; or

  • For local deliveries, upon handover to you at the delivery address.

5. Intellectual Property

All content on this website, including but not limited to text, images, logos, branding, graphics, and source code, is the intellectual property of The Branch (Pty) Ltd, unless otherwise stated.

You may not copy, reproduce, distribute, or use any content or trademarks without our prior written consent.

6. Limitation of Liability (CPA-Aligned)

6.1 Consumer Rights

Nothing in these Terms is intended to limit or exclude any rights you have under the Consumer Protection Act (CPA), including your right to safe, good-quality goods.

6.2 General Limitation

Subject to the CPA and to the fullest extent permitted by law, The Branch, its directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, or consequential damages arising from:

  • Use of, or inability to use, our website or Services

  • Any products purchased, except as expressly required by law

7. Bar & Lounge Use

Access to our 420-Friendly Bar & Lounge is subject to:

  • Separate house rules

  • Membership requirements

  • On-site policies and conduct standards

We reserve the right to refuse entry, suspend service, or remove any patron who breaches house rules, these Terms, or applicable law.

8. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of South Africa.
You consent to the exclusive jurisdiction of South African courts in relation to any dispute arising from these Terms or your use of our Services.
